CEE Digital Democracy Watch submitted a public comment to the Meta Oversight Board in response to case 2026‑021‑IG‑RA, which concerns the posting on Instagram of an AI-generated, sexualised video depicting a woman without her consent.
The Oversight Board, an independent body that reviews Meta’s content decisions and recommends improvements to platform policies, is examining Meta’s handling of this case and the company’s broader approach to such forms of synthetic content.
In our submission, we emphasise the need for platform policies to explicitly recognise non-consensual sexualising imagery (NSII) as a distinct category of harm, separate from adult content rules. We argue that age restrictions do not address the nature of the abuse, as the harm arises from the existence and circulation of such material itself, not from who views it.
The submission builds on our 2025 report Non-Consensual Sexualising Deepfakes: Threats and Recommendations for Legal and Societal Action. We welcome the Oversight Board’s focus on this issue and look forward to continued cooperation to improve online protection against AI-generated abuse.
